Following the retrial of Lord Emslie as Lord President of the Court of Session in 1989 the then Conservative Government introduced s.35 of the Law Reform (Miscellaneous Provisions) (Scotland) Act 1990 giving power to the Secretary of State, but in effect the Lord Advocate, to appoint temporary judges to avoid delays in the administration of justice in the High Court and in the Court of Session.
