We've developed templates with standard text which practitioners can adopt or adapt for use when instructing experts in family proceedings.

Under Part 26.3, you may apply for an order using Form D11 (application notice) declaring that you have ceased to act. Notice of the application must be given to your client unless the court directs otherwise and must be supported by evidence. Where the court makes such an order, it will be served on every party to the proceedings.

Unfortunately, like all precedents it can occasionally be misused either by judicial error or more likely by the police asking a Judge to sign it and missing key information off the draft Order. To protect you and your firm it is worth checking it meets the criteria set out in Section 345 of the Proceeds of Crime Act 2002.

The case management order template allows locally agreed standard directions for any of the suggested headings (and more, as appropriate). The mandatory headings should always be used unless there’s a reasoned basis for not doing so. You must always complete the case management system material referred to in the template.
