When the driver is at fault: If the cyclist is hit by a car, the at-fault driver's auto liability coverage can pay for the cyclist's medical expenses and the cost to repair or replace the bike. If the driver is uninsured, the cyclist will need health insurance to cover injuries.

A bicycle collision with a car, truck, or roadway hazard can result in serious injuries. Physical recovery could take months. You have a right to expect the at-fault motorist to pay for your personal injuries, pain and suffering, and property damage. Most bicycling accident claims are paid by the at-fault driver’s auto insurance company.

Leave your bike and other damaged property in the same state as after the accident—don't attempt to fix anything or have anything inspected. Don't wash your clothing. And don't send your bike, helmet, or any other equipment to anyone other than your attorney. Take photos of your damaged equipment.

When a car and a bike collide, the bicyclist is more likely to be hurt, but that doesn't mean the bicyclist can't be at fault for the accident. Bicyclists and drivers are required to share the road. Bicyclists who violate the rules of the road might not be able to get compensation for medical expenses, lost wages, and other damages (see below).
