One of the most impactful limitations upon a claim of Adverse Possession concerns government lands. The rule is simple: Adverse Possession can never be used to claim ownership over land that belongs to the State of Minnesota or United States of America.

Acquisition of Ownership: Under the Limitation Act, 1963, any person in possession of private land for over 12 years or government land for over 30 years can become the owner of that property. To claim adverse possession, the possession must be open, continuous, and adverse to the rights of the true owner for the required statutory period.

In India, adverse possession means that a trespasser or a stranger who comes into possession of the land must be in exclusive and continuous possession and without interruption for a certain period of time, typically 12 to 30 consecutive years depending upon the classification of ownership i.e., Private or Government of the land.
